Terms and Conditions
1. Validity of Terms of Sale
- a) These terms of sale apply to the rights and obligations arising between the buyer of the Wildberry.ee online store (hereinafter the Client) and LuxuryCanoodles OÜ (hereinafter Wildberry.ee) when purchasing goods.
b) By registering as a user of Wildberry.ee and/or purchasing products, the terms of this agreement and the rights and obligations arising from the legislation of the Republic of Estonia apply.
c) Wildberry.ee reserves the right to make changes to the terms of sale and sales prices. These changes will be reflected on the Wildberry.ee website.
2. Price Information
- a) The currency used is EURO. All prices in the Wildberry.ee online store include 20% VAT.
b) Wildberry.ee reserves the right to adjust prices. If the Client submitted their order before the price changes took effect, the price reflected on the invoice at the time the order was placed applies to them. The Client has no right to demand compensation for the price difference.
3. Placing an Order and Paying for Goods
- a) When paying for the order, the Client can choose a suitable payment method: Debit or credit card, Swedbank and SEB Bank via bank link, ESTO installment plan, PayPal digital wallet, or transfer based on an invoice. The Client pays 100% of the order amount to confirm the order, except in the case of an installment plan.
b) The sales contract is considered concluded and the fulfillment of the order begins immediately after the Client has paid 100% of the order confirmation.
4. Entry into Force of the Sales Contract
- a) The sales contract enters into force from the moment the total amount of the order has been received in the bank account of LuxuryCanoodles OÜ. Payments made by bank transfer may move slower between banks and the receipt of the amount may take time.
b) By placing an order and making a payment in the Wildberry.ee online store, the Client confirms that they have read and agree to the terms of sale.
5. Delivery
- a) After the sales contract enters into force (payment of the invoice by the Client), Wildberry.ee assembles the order and hands it over to our logistics partners for delivery.
b) The delivery deadlines indicated on the Wildberry.ee website apply from the moment the invoice is paid.
c) The Client is obliged to inform Wildberry.ee immediately of any change in destination or agreed time before the delivery of the goods.
d) Avoiding delays and misunderstandings in the delivery of goods depends on the accuracy and correctness of the data provided in the order. Wildberry.ee is not responsible for delays in the delivery of products or any misunderstandings if the delay or misunderstanding is caused by inaccuracies in the data provided by the Client when placing the order.
e) Wildberry.ee is not responsible for delays in the delivery of goods if the goods have been handed over to the logistics partners on time for the delivery day promised to the Client, but the delay is due to circumstances that Wildberry.ee could not influence or foresee. Please take into account that if there are public holidays during the delivery period, the delivery time may be longer than indicated next to the product.
6. Right of Return
- a) After the delivery of the order, the Client has the right to return the ordered products within 14 days. Products to be returned must be in unopened product packaging (Law of Obligations Act § 53 para 4).
b) If the goods have been used for purposes other than what is necessary to verify the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, Wildberry.ee has the right to reduce the refundable fee according to the decrease in the value of the goods. For hygienic reasons, the right of withdrawal does not extend to intimate products if the shipping packaging has been opened.
c) Wildberry.ee bears the costs related to the return of the goods if the delivered goods differed from what was ordered.
d) To return the goods, a return application (sample application) and the purchase invoice must be submitted to the e-mail address info@wildberry.ee within 14 days of receiving the goods. Wildberry.ee will respond to the complaint submitted by the consumer in writing within 15 days.
e) The money for the returned goods will be reimbursed to the Client after checking the returned goods, but no later than 14 days after Wildberry.ee has received the withdrawal application.
7. Liability
- a) Wildberry.ee is liable to the Client and the Client is liable to Wildberry.ee for damage caused to the other party by the violation of these terms in the cases and to the extent provided for in the legislation in force in the Republic of Estonia.
8. Force Majeure
- a) Wildberry.ee is not responsible for damages caused to you or for delays in the delivery of goods if the damage or delay in delivery is due to circumstances that Wildberry.ee could not influence or foresee.
9. Protection of Personal Data and Security
- a) By using the Wildberry.ee website, the Client gives clear and informed consent to Wildberry.ee for the processing of their personal data.
b) Wildberry.ee uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer. c) Wildberry.ee forwards personal data to transport service providers in order to deliver the goods.
d) Encrypted data communication with banks when paying for purchases ensures the security of the Client’s personal bank credentials, and Wildberry.ee has no access to them.
10. Direct Marketing and Processing of Personal Data
- a) Wildberry.ee sends newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish to do so by entering their e-mail address on the website and indicating their desire to receive direct mail notifications.
b) The buyer can opt out of offers and newsletters sent to their e-mail at any time by notifying us via e-mail or by following the instructions in the e-mail containing the offers.
11. Procedure for Submitting Claims
- a) According to the Law of Obligations Act, the Client has the right to submit claims for non-compliance of the product with the terms of the contract within 2 years from the receipt of the goods; for a defect that appears within the first six months, it is assumed that it existed at the time of purchase and the nature of the defect must be determined by the seller. A 2-month warranty from the receipt of the goods applies to batteries.
b) Upon discovery of a product defect, the Client undertakes to notify Wildberry.ee of the problem at the e-mail address info@wildberry.ee and provide the following information: name, contact details, order number, and the product defect. The corresponding application must be sent no later than within 2 months after the discovery of the defect.
c) In case of withdrawal from the sales contract, Wildberry.ee will reimburse the Client for the amount paid for the goods together with the postage costs to the bank account requested by the Client no later than 14 days after the return of the goods and the verification and identification of the defects.
d) Wildberry.ee is not responsible for:
- Damage to the product caused by the Client’s fault or negligence
- Defects resulting from improper use of the product
- Natural physical wear and tear of the product during normal use.
- e) All claims will be reviewed and the Client will be contacted as soon as possible, but no later than within 14 days of receiving the claim.
12. Settlement of Disputes
- a) If the buyer has claims regarding Wildberry.ee, they should be sent to the e-mail address info@wildberry.ee or by calling: +372 53461470
b) If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The procedural conditions can be reviewed and an application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.
